"Nivasa Finance" is a brand used by Niketan Financial Services Private Limited which is a sister concern of Nivasa Capital Private Limited. Both of these are wholly owned subsidiaries of Oka Housing Technologies Private Limited.

Welcome to the Nivasa Finance Platform (the “Platform”), which is owned and operated by Niketan Financial Services Private Limited (“Nivasa Finance,” “we,” “our,” or “us”). This document is a legally binding electronic record published in compliance with Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011, under the Information Technology Act, 2000. It does not require physical or digital signatures.

By accessing or using our Platform, you confirm that you have read, understood, and agreed to these Terms of Use (“Terms”) and our Privacy Policy. If you disagree with these Terms, please discontinue using the Platform.

Eligibility

Using the Platform, you confirm that you are at least 18 years old and capable of entering into a legally binding contract under Indian law.

Scope of Service

Nivasa Finance acts as an intermediary and Direct Selling Agent. Loan approvals and disbursements are subject to the discretion of our Partner banks/NBFC's regulated by RBI.

Proprietary Rights

Nivasa Finance holds all rights, title, and interest in and to the Platform, including all intellectual property rights. This includes but is not limited to the design, layout, content, trademarks, logos, text, software, and associated materials on the Platform. You may not copy, modify, or use any content without our written consent.

Use License

We grant you a limited, non-exclusive, and non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not reverse engineer, copy, modify, or attempt to derive the platform's source code or its components.

Restrictions on Use

You agree not to:

Use the Platform for any fraudulent or unlawful activity.
Misrepresent yourself or provide inaccurate information.
Interfere with the Platform’s operation or use any automated tools to gain unauthorised access.
Attempt to reverse-engineer or exploit the Platform’s software.

User Account Responsibilities

Users are responsible for maintaining the confidentiality of their login credentials. You are assumed to have conducted any actions performed using your account. If you suspect any unauthorised use, you must notify us immediately.

Our Platform may contain links to third-party websites for your convenience. We do not endorse these sites and are not responsible for their content or privacy practices. We encourage you to read each site’s terms of use and privacy policy.

Limitation of Liability

Nivasa Finance, its affiliates, directors, employees, agents, or service providers will not be liable for any damages, including but not limited to indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

Indemnification

You agree to indemnify and hold harmless Nivasa Finance, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses arising from your violation of these Terms or infringement of any third-party rights.

Modification of Terms

We may update or amend these Terms at our discretion. Any changes will be posted on this page, and your continued use of the Platform signifies your acceptance of such changes.

Governing Law

These Terms shall be governed by and construed by the laws of India. Any disputes arising from or related to these Terms shall be resolved in the courts of Bangalore, Karnataka.
